“A COP CONVICTED TO (8) EIGHT YEARS OF RIGOROUS IMPRISONMENT AND A FINE OF RS 5,000/- u/s 489 B and further 5 YEARS RIGOROUS IMPRISONMENT AND A FINE OF RS 2000/- u/s 489 C of the INDIAN PENAL CODE, FOR ALLEGED POSSESSION AND USE OF COUNTERFEIT NOTES”
Darjeeling, March 10, 2015: Darjeeling Court today announced the verdict on unique case of policeman involved in use of fake currency. On the 19 of May 2012, Inspector T.T. Bhutia, D.I.B. (West Bengal Police), apprehended Md Mustafa of Kachua, constable, P.S. Itahar of Uttar Dinajpur from Central Plaza shopping complex and recovered Rs 11,000/- fake notes. They further recovered Rs 37000/-whilst in Police custody. The fake notes were sent to Nasik Foresic Lab for confirmation, in which inference was drawn that the notes so seized from the possession of the accused were counterfeit.
The case was registered against the constable Md Mustafa of Kachua, Charge Sheet was submitted vide Sadar P.S.Case No 03/13 dated 25/01/13 u/s 489B & 489C of the Indian Penal Code.
In total 8 witnesses were examined and Mr Manojit Mondal, District & Sessions Judge, Darjeeling today convicted Md Mustafa, Constable, WBP under Section 498B & 498C. He is to suffer a Rigorous Imprisonment for 8 (EIGHT) years and a fine of Rs 5000/- in default to suffer a further R.I. of Six Months and under Section 489C of the I.P.C. for 5 (Five years and a fine of Rs 2000/-), i.e. to suffer further Rigorous Imprisonment of two months.
Investigating Officer of the case was Mr Chinmoy Bhattarjee, S.I. (Siliguri Commissionarate), while for the prosecution, government pleader was Mr. Pranay Rai, Chief Public Prosecutor, District & Sessions Court.
