Speaking to the press, GNLF leader Mr. Neeraj Zimba Tamang said, “3-teir panchayat elections under GTA is impossible… even if Gods descent they don’t be able to make that happen… only 2-teir panchayat polls is possible, and when that is held, the path to reestablishing DGHC will be made clear.”
Mr. Zimba said, ” In the GTA Agreement Section 26 clearly elucidates that Three teir Pachayat elections will be held… but this is ONLY subject to the provision contained in Part IX of the Constitution. Now the question arises as to what is contained in Part IX of the Indian Constitution?
Part IX of the constitution in Article 243(M) provides that :-
3) Nothing in this Part—
(a) relating to Panchayats at the district level shall apply to the hill areas of the District of Darjeeling in the State of West Bengal for which Darjeeling Gorkha Hill Council exists under any law for the time being
(b) shall be construed to affect the functions and powers of the Darjeeling Gorkha Hill Council constituted under such law. Zimba added, “That even if the Supreme Court orders for conducting elections in Darjeeling District, without amending the proviso of Article 243 M, No election can be held.”
Mr. Zimba said, “It was Roshan Giri who signed the GTA agreement without properly reading and understanding Section 26 of the GTA Agreement and Part IX of the Indian Constitution… isn’t he aware that without constitutional amendment 3-teir Panchayat elections are not possible… and they have done nothing to change the constitution.”
